General Terms and Conditions (GTC) for the online store of Totika Nature Switzerland KIG

 1. Scope of application and contractual partners

  • The following General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed via our online store www.totikanature.ch.
  • Customers include both consumers and companies. A consumer is any natural person for whom the purpose of the order cannot be attributed to a commercial or professional activity of the consumer, but rather to personal or family use. A company, on the other hand, is a natural or legal person or a partnership with legal capacity that orders for commercial or professional purposes.
  • The contractual partner for your orders is Totika Nature Schweiz KIG, represented by Samira Stüssi and Simon Wey, 5522 Tägerig, Aargau, Switzerland, info@totikanature.ch.

2. Conclusion of contract

  • Your order constitutes a binding offer to conclude a purchase contract.
  • After sending the order, you will receive an automatic confirmation by e-mail, which documents the receipt of your order by us.
  • A contract is only concluded when we confirm your order with a separate order confirmation by e-mail or send the goods to you.

3. Prices and terms of payment

  • All prices are in Swiss francs (CHF) and include the statutory value added tax of 2.6% and 8.1% (as of 01.01.2024) and additional shipping costs.
  • Payment can be made by prepayment, invoice or credit card. We reserve the right to exclude payment on account for new customers.
  • If you choose to pay in advance, we will give you our bank details in the order confirmation. The invoice amount is to be transferred to our account immediately after receipt of the order confirmation.
  • We only accept credit card payments from accounts within Switzerland and the EU. Under no circumstances do we assume the costs of a money transaction.
  • When purchasing on account, customers receive the goods first and have a payment period of 30 days. In the event of late payment, the following procedure applies:

       1. a payment reminder is sent by e-mail.

       2. a reminder is sent by e-mail with reference to a third       reminder, which is sent by post and includes a reminder fee of CHF 20.

       3. a written registered reminder is sent by post with an additional CHF 20 reminder fee and a reference to the fact that the defaulting payer appears on Totika Nature's "black list". In addition, a debt enforcement request will be submitted to the competent debt enforcement office.

4. Shipping and delivery conditions

  • Delivery is carried out by Swiss Post. Totika Nature ships from Monday to Friday. The parcel is sent by Priority Post (A Mail). Delivery takes place within 2-5 working days of receipt of the order, unless otherwise agreed. No liability is accepted for delays on the part of the post office. 
  • Delivery takes place within Switzerland and Liechtenstein and is free of charge for orders over CHF 140 for private customers and CHF 500 for companies.  
  • The shipping costs with Post Economy are CHF 8.50 per order up to 2kg. For orders from 2kg to 10kg we charge CHF 11.50 as shipping costs.
  • The shipping costs with Post Priority are CHF 10.50 per order up to 2kg. For orders from 2kg to 10kg we charge 13.50 as shipping costs.  
  • Orders for deliveries abroad are generally possible under the conditions of these GTC, but delivery times and shipping itself must be agreed individually and in writing.
  • If a buyer does not accept the goods, Totika Nature may, at its discretion, either sell the goods to a third party after a period of two weeks and hold the original buyer liable for any loss incurred, or insist on performance of the contract. Totika Nature's other legal claims remain reserved.
  • You will be informed of any delays in delivery as soon as possible by e-mail.
  • Should events occur that make delivery significantly more difficult or impossible for Totika Nature - for example strikes, lock-outs, official orders or similar - Totika Nature shall not be responsible for delays, even in the case of bindingly agreed deadlines and dates.
  • If an item is not available due to bottlenecks or force majeure, we reserve the right not to deliver the item. In this case, the credit card will not be charged, in case of prepayment a refund will be made.
  • Refund claim: In the event of incorrect payments, the excess amount paid will be credited to the next order. A chargeback will only be made on express request.

5. Right of withdrawal and returns

  • Unfortunately, it is not possible to exchange the foodstuffs we send, as they are perishable goods. There is no right of withdrawal.

6. Retention of title

  • The delivered goods remain our property until the invoice amount has been paid in full. In the case of companies, we reserve title to the goods until all outstanding claims arising from the business agreement with the customer have been settled.

7. Warranty and liability

  • The statutory warranty provisions apply.
  • We are not liable for damage caused by improper use or storage of the goods.
  • The buyer must inspect the delivered goods immediately upon receipt for defects with regard to their condition. Warranty claims of the buyer due to obvious defects are excluded if these defects are not reported in writing within a period of one week after receipt of the goods.
  • Please consult your doctor in the event of known intolerances. The same applies to possible interactions with other products you are taking at the same time.
  • Our product is a natural product and is sold as a foodstuff and expressly not as a remedy.
  • The products offered on www.totikanature.ch and the information presented or linked must not be regarded as a substitute for professional advice or treatment by recognized doctors. The content of these Internet pages cannot and must not be used to make independent diagnoses or start treatment. Totika Nature accepts no liability whatsoever for material or immaterial damage caused by the use or non-use of the products and information provided.

8. Data protection

  • We process your personal data in accordance with the applicable data protection regulations. For details, please refer to our privacy policy.

9. Applicable law and place of jurisdiction

  • The law of the Swiss Confederation shall apply exclusively.
  • The District Court of Bremgarten shall have exclusive jurisdiction in the event of disputes.

10. Severability clause

  • Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, this shall not affect the validity of the remaining provisions of this contract. The invalid or unenforceable provision shall automatically be replaced (without further negotiations by the parties) by a valid and enforceable provision whose effects come closest to the economic purpose of the invalid or unenforceable provision.

11. Amendment of the GTC

  • We reserve the right to amend these GTC at any time and without giving reasons. You will be notified of any changes in good time and they will apply from the time they are published in the totikanature.ch online store.
